This is an english translation of our 'Privavy policy'. Only legally binding is our german version. Thank you for your understanding!

The following privacy notices are intended to inform you of how we share your personal information in connection with the operation of this website (www.PureArea.net) and your customer data in connection with ordering a software license (PureBasic, SpiderBasic and/oder PureVisionXP) and providing an associated download access (www.purebasic.com or www.spiderbasic.com). In doing so, we comply with the strict provisions of German data protection law as well as with the requirements of the European General Data Protection Regulation (DS-GVO / GDPR).

2. Scope and legal bases of the processing of personal data:
We collect and use personal data of you only as far as this is absolutely necessary for the provision of our contents and offers. The collection and use of your personal data takes place regularly only with your consent or on your own initiative.

There is a distinction between:


a)
Content and use of this website:
At the current status (May 2018), no personal data is collected or stored about the users of this website.
The script used for the visitor counter ("traffic") stores no user data, but temporarily stores only the IP addresses of the last max. 10 visitors to avoid double counting at the visitor counter.

For participants on the "PureArea.net Showcase" by default only a self-assigned user name, a password and a contact email address are stored. Other information such as real name, website, address or used system are optional and non-obligatory.
This data is stored in a secure online database for the duration of the showcase. The legal basis for the processing of this data is your consent in accordance with Art. 6 (1) sentence 1 a) GDPR.

In addition, there is no use of cookies, Google Analytics or similar to create user profiles, etc.

Our hosting provider stores usage and access data (e.g. name, URL, date and time of retrieved files, browser type and version, operating system, Internet provider and IP address of the user) to analyze the traffic, troubleshoot and fix errors as needed or to improve available services. These are legitimate interests in an efficient and secure provision of our website in accordance with Art. 6 para. 1 p. 1 f) DSGVO in conjunction with Art. 28 GDPR.


b)
Customer data from PureBasic / SpiderBasic and / or PureVisionXP users:
If you order a license of PureBasic, SpiderBasic and/or PureVisionXP through me - either on the basis of the offer on this website (see "Order" section) or via www.purebasic.com ("Offline ordering" section) - the following personal data will be stored:
  • Company name: (optional)
  • Last name + First name (if necessary of the administrator)
  • Street, House number, Postcode, City
  • E-mail address.
These data are required for the processing of the order, meaning for the registration as a licensed user and for creating a personal download account (for PureBasic on www.purebasic.com, for SpiderBasic on www.spiderbasic.com) or for creation / transmission of a full version keyfile (for PureVisionXP) as well as the clear identification in a (later) support request.

The legal basis for the processing of this data is Art. 6 (1) sentence 1 b) GDPR, because this data is needed so that we can fulfill our contractual obligations to you.


In sum it can be said, that we store only a minimal amount of personal data of our website users and registered users, which is essentially limited to the email address and (for registered users) to the address.
Since we do not operate an online shop and license orders are usually only made once, in particular no data such as order history, notepad, interests, etc. are stored.

Storage and transfer of personal data:

In principle, we store personal data only as long as necessary to fulfill the purposes pursued. How this works in detail, please refer to the following description.

a) For users of this website:
Personal data that you have submitted as part of a separate application for the "PureArea.net Showcase" will be stored in a secure online database at my provider (All-Inkl.com). The storage is basically unlimited in time, as the provision and usability of the "Showcase" is possible in the long term. With the exception of the created user name (and, if applicable, linked with submitted projects) you can delete all personal data at any time or request the deletion. A transmission in text form (email, letter) is sufficient.

b)
Customer data of licensed users:

PureBasic and SpiderBasic are software products of Frédéric Laboureur and the following company:

For both software developers I distribute on behalf the related user licenses. For the purpose of registration and (later) unambiguous identification of users for the purpose of providing full versions of the mentioned software products (for PureBasic + SpiderBasic via a protected download account on www.purebasic.com, for PureVisionXP by providing a full version key) your above mentioned customer data will be forwarded to the aforementioned software developers.

Similar to your order, this is done either by email or for PureBasic / SpiderBasic by entering your data in a password-protected registration form (on www.purebasic.com or www.spiderbasic.com). The storage of your personal data and the securing of the necessary data protection are therefore the responsibility of the two companies mentioned above.

For billing purposes (with the software developers mentioned above and the tax office) in connection with newly registered customers and the forwarding of license fees and for the identification of registered users in the event of a later support request (for example, restoration of a download account) I store the following data from your customer data:

  • Company name (optional)
  • First and Last Name
  • Country
  • E-mail address
  • Order date
  • License type / price
This data is stored in a password-protected Excel file on my computers / backup media.

Since the licenses of all mentioned software products are available indefinitely according to the valid license conditions, the use of the respective software product and a possibly provided download account as well as a support request are generally still possible years after the original order.
Against this background, the storage of your customer data is basically unlimited in time.

Apart from the aforementioned software developers, your customer data will not be passed on to other third parties.
In principle, your customer data is only used "passively" to identify registered users - that means because of your active contact (order or support request). There is no active customer approach on my side, unless this was previously expressly agreed (for example, interested in a full version license).


4. Your rights as data subject:

Of course, you have rights in relation to the collection of your data, which we hereby inform you about. If you would like to assert these rights, please send your request by e-mail or by post with a clear identification of your person to the address stated in section 1.

Below is an overview of your rights:

    a) Right to information

    You have the right to ask us for information about the personal data stored about you.

    b) Right to rectification

    You have the right to demand that we correct and / or complete the personal data concerning you.

c) Right to be erased ("right to be forgotten")

You have the right to request the deletion of your personal data stored by us.

However, we would like to point out the following: Your personal data is required for licensed software products (PureBasic, SpiderBasic and / or PureVisionXP) to fulfill the contract, ie provision of download access, customer support, etc.
We can only fulfill your request for deletion of all your personal data, if you at the same time declare the replacement and irrevocable waiver of the further use of the respective user-related software license(s).

    d) Right to restriction of processing

You have the right to request the restriction of the processing of your personal data.

The data collection and processing on our part is anyway limited to a minimum, so please also note the information under 4 c).

    e) Right to information

    If you have asserted any of the aforementioned rights to rectification, erasure or restriction of processing, we will forward this correction or deletion or limit processing of the personal data related to you to all recipients (in the case of a license purchased from me, the above-mentioned software companies), unless it proves impossible or disproportionate.

f) Right for data portability

You have the right to get the personal informations provided to us, or that we provide them to a third party in a structured, common and machine-readable format.

    g) Right to object

    If your personal data is processed based on legitimate interests pursuant to Art. 6 para. 1 lit. f GDPR, you have the right to object to the processing at any time in accordance with Art. 21 GDPR.

    h) Withdrawal of consent

    You have the right to revoke your consent to the collection of data at any time with effect for the future. The data collected until the legal validity of the revocation remains unaffected.

    i) Right to complain to a supervisory authority

    You have the right to lodge a complaint with a regulatory authority (the EU Member State of your whereabouts, place of employment or place of alleged infringement) if you believe that the processing of your personal data is unlawful.

5. Data security:

We make every effort to ensure the security of your data within the range of applicable data protection laws and technical possibilities.

Your personal data is stored encrypted with us.
(Please note the informations about data transmission to and data storage at the software companies mentioned under 3.)

Furthermore, we point out that the transmission of data on the Internet (for example, in the case of communication by email) may have security gaps. A complete protection of the data from access by third parties is not possible.

6. Change of privacy policy:

In order to ensure that our data protection guidelines always comply with the current legal requirements, we reserve the right to make changes at any time.

This also applies in the event that the data protection information must be adjusted due to new or revised offers or services.
